See this shit all the time. Makes me want to punch some fuckers in the face. Seeing/Hearing people looking forward to their spouse/parents/relatives/inlaws dying so they can get some money is fucking sickening. Even worse than that is hearing about people wanting to cut corners on treatment, physical therapy or living conditions to preserve assets at the expense of their parent. Yeah that is a lot of BS. Seen some terrible shit go on in my family. I had a great aunt that had Alzheimer's pretty bad and she got put in a nursing home when my uncle got cancer and couldn't care for her. When he died his family came in his house, changed the locks and proceeded to take anything they wanted, including money in bank accounts. Then when they were through, they opened it up to my aunts family. She wasn't even fucking dead yet! They took a lot of my great grandmothers things that should have been given to my aunts side. People are assholes. I think there was a lawsuit if some kind but not much recovery.

So, basically, I say fuck it and sign it over or I approach an estate attorney to see if there is another way? Dude, for $10k I would definitely at least reach out to an expert in Iowa estate law. It might cost you half an hour of his/her time (probably $200) but they'll know more about it than anyone on a board. Based on the link I gave you above, I sure as shit wouldn't be buying a new Miata with the money, though. I will look into it. Thanks for your input.

If it's cash/equivalent of decedent Medicaid is getting paid. I think for your situation it's advisable to speak with an estate law pro. My hunch is that Medicaid is gonna get it if it emanates from the estate but I'm not secure enough in that assessment to offer that as fact. Furthermore Medicaid itself is more complicated now due to the Kenyan Interloper.
Sheldon Kurtz would in fact hammer that shit down in a matter of seconds.

So now Medicaid is Insurance. Always has been. Universal insurance for the poor. But if the man finds out you weren't "poor" enough (and the threshold for poor is very, very, very fucking poor) they are gonna claw back anything they can. Owing Medicaid money when you die basically invites bankruptcy court level scrutiny of your estate.

I know typical insurance or tort recoveries are generally subject to a super priority lien for Medicaid claims, but it seems liek you would run into this shit on occasion, too.

I know typical insurance or tort recoveries are generally subject to a super priority lien for Medicaid claims, but it seems liek you would run into this shit on occasion, too. Beginning in October (although there is talk about a two year delay) Medicaid has a super lien against third party liability recoveries and possibly even work comp. the entire recovery is eligible, not just the portion allocated for medicals. That's a big fuckin deal. I imagine they'll start demanding set asides for future medicals in comp cases. Medicare already has a super lien and set aside requirements. EDIT The Medicaid super lien covering the entire recovery amount has in fact been delayed until October 2016.
