If said desk is in your casa, it gets pretty difficult to claim these days.

I have a rather large L-shaped desk with a hutch. Kind of like this. I spend a lot of time sitting at that thing. I have begged my boss for a sit-to-stand type desk...for my health. Lots of studies show that sitting all day is not good for you and I agree and noticed a decline in my endurance. I gave up on getting a treadmill desk but with an adjustable sit to stand desk I could eventually stand most of the time. I figure, maybe if I buy my own, I can at least deduct it on taxes. This place has what I am looking for. I've tricked it out with monitor, PC and keyboard holders/trays and it comes to about $1000. My boss spent twice as much 10 years ago for the desk I have now. I think I should get a new one but the answer is no. www.thehumansolution.com/uplift-laminate-desks.htmlMaybe I'll just do this.

I know, right? I actually would be more worried about being able to hide under my desk in case a disgruntled patient or employee went postal.
Is that even a term anymore? When was the last time someone officially went postal at the post office?

If said desk is in your casa, it gets pretty difficult to claim these days. Let me see if I have this right: Big government sucks because it steals ur money and gives it to lazy undeserving brown people! and/or Big government sucks because it should allow you to pass along to other taxpayers the cost of a new desk for ur house. Tax deductions and "write offs" are wealth redistribution plays. But it's all right if it's all white. I think all he said was "it gets pretty difficult to claim these days".

I didnt offer any judgement as to the justice of making it hard for people to scam new furniture for their casas as business expenses deducted from their taxes. I just pointed out that it was dificult to do any more.

No, you can't deduct it. Your cheap-ass employer should provide it for you. Approach it as an ergonomic issue -- that carries far more gravitas than you simply want a different desk because you want to stand. Oh I have...for the last three years. I've complained about a constant nerve pain in my ass...not related to my boss or husband.(piriformis syndrome-athletes get it...or people that sit on their ass all the time) I've sent him articles about the health risks of sitting so much. I emailed the guy that's in charge of employee ergonomics. No answer. My coworker had a different office...very, small, and he didn't have a desk...a counter top. After reading the info I was sending to our boss , he had maintenance raise his counter to standing height. Now he's moving into the office next to mine. Since our boss didn't think to order a new desk for this larger office, he's having maintenance make one with a piece of countertop and maybe some filing cabinets. Ridiculous. My boss offered to have them put in a counter top that hugged the wall instead and I said no way as my side or back would be to the door. No effing way.

To answer your question, I am not an accountant and suggest you consult one, but I would think that absent other deductions incurred in connection with the carrying on of a trade or business, NO, the purchase of a desk would NOT be deductible. Pursuant to Section 67 of the Internal Revenue Code, you generally need to incur 2% of your income in business expenses before you can get a deduction for costs incurred in connection with carrying on a trade or business. I doubt you have this. There is an exception in 67(d) for "handicapped individuals" but I don't think you would meet that definition. www.law.cornell.edu/uscode/text/26/67Your deduction would presumably come through 162, which is not exempted from the 2% limitation (unless you are liek me and work in a pass through and get butt fucked wif bof sides of socialist insecurity and Medicare taxes): www.law.cornell.edu/uscode/text/26/162If your employer doesn't have an ergonomic specialist who sets up the work spaces, they should have one. We have a gal who goes to everyone's office to make sure their desk and the computer peripherals are a good fit because the firm is worried about someone getting carpal tunnel or some other problem that could lead to liability for the firm. It is amazing that a health care provider doesn't have one of these.
