What has changed between the first time I took and now is that the entity that writes the questions now licenses out the questions (for a fee, of course) and sells them. They did not do this back in ought six when I took it. The bar prep market is very lucrative and BarBri was the subject of an antitrust suit about 10 years ago. My guess is that the organization that runs the bar is intentionally writing questions away from the commercial prep courses so that they compel people to buy the exorbitantly priced "official" questions. It is classic behavior of an entity using a monopoly in one market (this company controls the bar in 49/50 states) to strong arm its way into control of a second market (prep). Furthermore, the company administering the test has an incentive for people to fail, as retakers add revenue. My guess is it would be really interesting to do discovery on that company.

You'd think states like that could use a little imported legal talent. SC is due to Hilton Head and Charleston. They don't want retirees moving in. Same theory as Florida. Indiana is attempting to protect their system from all the lawyers in Chicago. And they have absurd pro hac rules so if you get sued in Indiana and want to hire Kirkland or Sidley for specific expertise, you pretty much can't unless they partner with local counsel.
