I just noticed that some people have begun to address the child rape case I brought up in the SCOTUS thread. I explained that while it would pain me do so, as a strict constructionist I would have to knock down Louisiana's child rape law. (equal protection)
I do feel that the maximum penalty allowed under the law should be applicable to rape cases where there is a propensity for the criminal to repeat his offense.
However, only someone who's views are not written in the constitution would allow the Louisiana law to stand.

depends. If a drunk girl at a bar changes her mind the next day about the sex you had last night, should you get the death penalty?
of course, people who rape little kids often get killed in prison in a more horrific manner than the death penalty because the general population considers them to be sick individuals.

depends. Note that i did not suggest mandatory sentencing, that is for a judge to determine. Secondly, you would have a jury trial, assuming it actually went to trial.

Nothing should carry the death penalty in my opinion. Even though child rape is a horrific crime, it doesn't deserve death. Nothing does.
If we want to evolve as a species we need to stop with the "Eye For An Eye" mentality.
Besides, life in prison is worse then death anyway.

After reading some people's interpretation of rape are from the boards at HN...no. I won't say too much of what was said, but according to some, my wife and I (boyfriend/girlfriend at the time) raped each other constantly in college.

I don't believe in the death penalty. Period. I'm with roxxstar on this one. I also think that whatever punishment is doled about by fellow prisoners against kiddie rapists is far worse than any kind of state sanctioned death.

Not only do I support the death penalty (and not letting them rot on death row for decades), I'd be willing to consider partially commuting sentences of those prisoners who kill worthless POS's like child rapists so the State doesn't have to. Killing a pedaphile is proof that you can indeed contribute to society afterall.

You always hear/hope for stories such as, yeah this one guy that raped half a dozen little girls in florida will be spending the next 25 years in a federal prison where they will be in prison and subject to their fellow inmates brutality. But if they go to prison and get "taken care of" by their fellow inmates then why do so damn many repeat when they get out of jail? And then proceed to get caught and we always hear their stories on TV, yeah so and so was released from prison on such and such a date only to re-offend and rape X amount of children, AGAIN? That shit just bugs me. If they are at all a risk to re-offend they should never be able to see the light of day again.
