Communism. (1) The Civic Center Act requires the governing body of a school district to grant the use of school property, when an alternative location is not available, to nonprofit organizations, and clubs or associations organized to promote youth and school activities. Existing law also prohibits an individual, society, group, or organization from using school property for the commission of any act intended to further a program or movement the purpose of which is to accomplish the overthrow of the government of the United States or of the state by force, violence, or other unlawful means. This bill would permit the school board to require the furnishing of information as it deems necessary to determine that the use of school property for which application is made would not violate that provision. This bill would also delete provisions regarding a person who intends to use school property on behalf of an organization to deliver a statement, signed under penalty of perjury, that the organization is not a Communist action organization or Communist front organization required to be registered with the Attorney General of the United States or does not, to the best of that person' s knowledge, advocate the overthrow of the government of the United States or of the State of California by force, violence, or other unlawful means. (2) Under existing law, a permanent or classified school employee, or a classified community college employee may be dismissed from employment for specified causes, including, but not limited to, commission of a felony. This bill would delete provisions that a permanent or classified school employee, or a classified community college employee may be dismissed from employment if he or she is a knowing member of the Communist Party. (3) Existing law prohibits a teacher from giving instruction and prohibits a school district from sponsoring any activity that reflects adversely upon a person because of his or her race, sex, color, creed, handicap, national origin, or ancestry. This bill would delete provisions that prohibit a teacher giving instruction in a school or on property belonging to an agency included in the public school system from teaching communism with the intent to indoctrinate or to inculcate in the mind of any pupil a preference for communism. The bill would also delete provisions that a teacher may be dismissed from employment if he or she teaches communism in that way. [ b](4) Under existing law, a public employee is required to answer, under oath, specified questions, including, but not limited to, knowing membership in an organization advocating the forceful or violent overthrow of the government of the United States or of anystate. This bill would delete these provisions. The bill would also delete related findings and declarations by the Legislature regarding communism and the Communist Party.[/b] Vote: majority. I'm sure if you dig a bit, you'll find similar legislation requesting modification of "anarchist" or "negro" or "horse and buggies". Thanks for the scoop. With the current income tax/transfer payment scheme in this country and the 10.25% sales tax that just passed for Chicago (Democrat since the days of Capone), we can clearly say that the term "Communist front organization" would preclude the modern "Democrats" from utilizing the facilities. Furthermore, Jonah Goldberg conclusively demonstrated in his book, Liberal Fascism, that the greatest threat to freedom is not the jackbooted stormtrooper, but rather the Brown or Swarthmore educated (I'd add Drake, too) grade school teacher indoctrinating these kids with leftist ideas about taking from the "rich" (those who have jobs) and giving to the poors. You see my friend, the commies aren't coming, they're already here.

The point being that any ideology that can be pushed by teachers without fear of discipline is wrong. Seriously Ghost, are you for "the intent to indoctrinate or to inculcate in the mind of any pupil" the political leanings of a teacher regardless of ideology? I'll admit, the current law about employees having to disclose any affiliation with entities trying to violently overthrow the US or any state is a bit intrusive. The Indians still have land so they can build casinos which will then contribute to a state's tax revenue.

The problem, iammrhawkeyes, is that the liberals have forcibly removed the Pledge of Allegiance from schools due to its "Under God" reference. Thus, the liberal loony union member knuckle dragger brown shirt jack booted stormtrooper liberal fascist teachers forget about things like allegiance, indivisibility and liberty and justice for all. Now high school teachers are going to start turning into mini Ward Churchill's and spreading their anti-American ideology to kids as young as 14. Then, middle school teachers will start, followed by elementary school teachers. Troubling times, indeed.

The Pledge wasn't being recited in our daughters classroom at the start of the school year. My wife and I wrote several letters to the teacher and principal stating that California law requires that it(or some other Patriotic exercise) be conducted at school every day(thogh individual students may opt out). We caught a bunch of crap for this but The Pledge of Allegiance is now being recited at school.

Communism is simply a political system. I get bagged by people when I call someone a socialist because of ignorance. Socialism is merely an economic system, and if you espouse it's doctrines... embrace the title. Communism should be taught for what it is, so should socialism.
I don't believe in the redistribution of wealth, but if you do... I agree to disagree. I don't believe in a classless society with common ownership of land and production, I feel it has been shown foster a corrupt (and yes lazy) society in which the classes are actually stratified.
If one doesn't believe communism is the way to go, (and they think it can be done without corruption) so be it.
As for me, I will take the constitutional republic that we used to have, prior to the gross corruption of the Inter State Commerce clause.

No need for flag burning, even in a 60 yo socialist "welfare state". It's best to raise someone to think for themselves, If they adopt your views, fight those battles where they belong... a courtroom. Maybe they will become a great ACLU lawyer. Maybe they will champion the constitution and fight the gross missuse of the interstate commerce clause, maybe they will... embrace the pledge, but champion real change. No need for gimmicks, raise them to make results. Ruffling feathers may make you think your a bad ass, but real bad asses use the system and the rules for change. I.e. A bad ass would get a constitutional amendment for socialism and shut me the f up. A coward would champion "expanding" the interpretation of the constitution so it's word isn't the law, it is the current interpretation of the law.

Filburn is the be all end all and refuse to accept the fact that Fuhrer Roosevelt had less respect for the separation of powers than their most despised enemy, W, the commerce clause stands. The interstate commerce clause has become a super-precedent that can never be overturned.
The bigger battle now is prolly the takings clause of the 5th Amendment - which the SCOTUS butchered the shit out of a few years ago in the Kelo case.
Guys like me will long argue that some amount of taxation has to be repugnant to the takings clause, but from reading the views of the ultra leftists on this board, it is clear that my opinion is in the minority and that the Dems are free to raise taxes as high as they want and as a result, only the court can stem the tide of populism that threatens to turn modern liberal fascism into full blown socialism.

Honestly man, I'm not against leftist thinking, I'm more against leftist laws. Yes I hate taxes, but something has to be said for their stance against "our", war spending. However, as long as their willingness to spend money (federal) on repugnant causes continues, I am unwilling to truly lay a hand on their argument. When they stop unconstitutionally taking money from our pockets, then maybe I can hear their views on foreign policy. Then I agree the war is far to expensive- that is... without conservatives taking oil in exchange. Take the oil for damn sakes, I have no problem with imperialism so long as it increases the standard of living for Americans. I really don't mind war being for business... hell, for about 3000 years it was. What is so bad about taking petroleum from the hands of people who (grant it may only be 10%, but 10" of a billion is 10,000,000 wackos) want to kill children and innocent civilians. Yes, if the constitution were followed we would be wasting billions on the drug war- to kill a plant. We wouldn't be redistributing wealth on a federal level. We would still be a nation that "would have to be talked in to taking money"-even to feed our children. In this respect FDR was right let me quote him, "Dependence [on welfare]," said FDR in 1935, "induces a spiritual and moral disintegration fundamentally destructive to the national fiber. To dole our relief in this way is to administer a narcotic, a subtle destroyer of the human spirit." FDR... was he evil, no, Was he naive, maybe... He was definitely ignorant. Thinking that during a time of emergency, congress would return it's unconstitutional powers. He certainly would piss on the graves of the majority of the false "liberals" today. This, our hand out, no accountability nation... rests on his ignorance. I see property being taken from an individual on a local level, and sold to his cooperate rival. I see families (who work) struggle but don't fit into the impoverished income level to get help. I single mothers that want to work but can't because it's more economically feasible to Social Security and fip then work. That mother wouldn't be in this situation if she still had human spirit... If she, like her great grandmother, before her would rather starve than take a hand out. The only answer is strict constructionalism. I won't vote for a viable party anymore (republican or democrat). While I may decry anyone for doing so, I secretly vote for the "nazi" republicans, simply because I don't want blatant traitors sitting on the bench. Call me an ass, call me a libertarian... But for god sake' if you disagree with me politically, you are most likely disagreeing with the constitution. BTW, where the hell is dweeb?
