Prosecutors turning over exculpatory evidence to the accused is a threat to our democracy and I hope the judge rules accordingly. This could ultimately be a matter that makes it all the damned way to the US Supreme Court. Then, 20 years from now in addition to reading about the legendary Jim Bain lawsuit as it relates to third party beneficiary of contracts law, Iowa and ISU football could easily be a focal point for a critical digital Fourth Amendment opinion that young law students study. Of course, who can forget the seminal case involving Virginia Polytechnic Institute and its former ball play, Mr. Antonio Morrisson, whose shenanigans made it all the way to the Supreme Court and invalidated sections of the Violence Against Women Act for being broader than the powers vested in the Feds via the Commerce Clause. |

Hmm, I don't know if that is a search. I mean, I know it would be a search if I was on the SCOTUS, but I'm not. In order to achieve the utopia that our overlords have planned I suspect the justice system is gonna need to argue this ain't a search. |

Matt Boles, Van M. Plumb, and Sandy Law Firm have filed a motion to suppress for former and current Cyclones Eyioma Uwazurike, Jirehl Brock, Isaiah Lee, and Paniro Johnson.
The motion details and alleges that use of the software program Kibana was used to place a geofence around Iowa State athletic facilities where accounts with online gambling sites were accessed without a warrant.
The motion further alleges Iowa DCI then issued county attorney subpoenas to gain access from the online gambling sites to discover who the accounts were registered to, contrary to established rules in issuing county attorney subpoenas.
The attorneys state that the warrantless search and issuance of subpoenas resulted in a small number of indictments in comparison to all the data obtained.
Portions of the motion state:
“At the time of viewing the historical data points, Agent Sanger did not have any tips or specific information suggesting that match fixing and sports wagering cheating were occurring at Iowa State University Athletic Department training facilities.”
"Defendants were specifically told that officers were going after online sports betting companies, and that they were not the targets. Defendants were not read their Miranda rights and were told they weren’t under criminal investigation. Defendants answered officers’ questions, provided information, and surrendered their cell phones and passcodes to officers… It is clear that an inducement was offered to the Defendants to cooperate with the officers. The coercive conduct and promises of leniency by the officers make any statements made involuntary, against free will, and contrary to Defendant’s constitutional rights…
"On January 25, 2024 GeoComply sent the letter of their intent to disable access of Kibana to the DCI. The letter confirmed that at IRGC’s direction GeoComply provided certain members of the Iowa DCI access to Kibana on the understanding that such tools would be used for limited-scope purposes, and that it had come to their attention that DCI may have exceeded the intended outlined scope of its Kibana access-and-use privileges. Geocomply informed IRGC that DCI’s access to Kibana would be disabled effective January 26, 2024…
"The State cannot claim that they were unaware a warrant should have been issued in this case. On April 14, 2023, Special Agent Duenow, a member of Sanger’s team, obtained a GeoFence warrant so that Kibana could be used in the investigation of Mr. Hobbs and Mr. Buckhanan. (See Attachment A). These two young men, age 19, were using Mr. Buckhanan’s father’s application to place underage bets. It should be further noted that even though these young men were investigated by the same unit, at the same time, as that which investigated Iowa’s Student Athletes, they were only charged under Iowa Administrative Code 99F.9(5) for underage gambling. See Worth County case number STA0036094. Iowa’s student athletes who gambled underage were charged under the Iowa Criminal Code for indictable offenses."
