My HO policy only pays if the damage is unforseen and an act of God. As the tree is clearly dying/dead and hanging over my property it aint unforseen, especially if he's been notified. FFS wut do you fink we are talking about here? FYI- an act of god IS your shitty neighbor's tree falling on your house after a storm or a day when there are high winds. In fact I would call your insurance guy to come out and take a look at it. They will probably jack up your premium now to prepare for the inevitable claim they are going to pay at some point. Tell ya what, I will type slow so you can follow. A normal healthy tree that falls in a storm is an unforseen act of gawd. A dead/dying tree that has been shedding limbs for years, and is positioned in such a way that if it falls it will likely cause property damage is a foreseable event especially once he's been notified (in this case by me). If he fails to act and the tree lands on my garage the damage is now caused by his negligence (failure to remove a dangerous tree). Because he was negligent his HO policy is now on the hook, unless he pays me cash out of pocket.

More ideas:
-Don't dandelion spray the half of your lawn bordering the tree owner. If he bitches, tell him you didn't want to waste the $ on lawn that may soon be covered by his dying tree.
-Shorten the downspout from your gutter so it only goes 1/4 way down your house. Buy a long or flexible extension for the bottom to aim the flow at one of his windows. You could even narrow PVC the fucker so you get some pressure.
The 2nd one is guaranteed to start up a conversation.

I cld chuck dog shit over the fence into his yard. Last summer while loading up the car for a trip the dog got out and tan into hos yard for about 30 seconds and ate a peice of bread his fat whiff frows for teh birds. 3 days later a community police occifer came to our door and informed me a neighbor complained about our dog being in their yard.

In all seriousness it depends on how big of an asshole he actually is and whether you know that or not. Grow some balls and chat him up the next time you see him outside or go knock on his door with a sixer of PPR. Ask him his thoughts and express your concerns and then go from there. If he is an asshole and tells you to fuck off (I highly doubt this would happen) then take all the other advice in this thread. If he's a reasonable prole tell him you will do the leg work to get a quote, see what the cost is, let him know you will pay some or all of the bill since you are the one with the issue and go from there. And for the record it's his tree and he can tell you to fuck off and there isn't a damn thing you can do about it and if the tree does fall on your house his insurance company is going to laugh their ass off at you for thinking they will pay as it will be your insurance company that will be paying the claim not his. TLDR- Don't buy a house next to some prole with a giant dying tree in their front yard.
